Description

MERRITT, Chief Judge. Defendant Bobby McDougald appeals his jury conviction for money laundering in violation of 18 U.S.C. § 1956. He was sentenced to eight years in the federal penitentiary. He is accused of buying a car for a drug dealer knowingly using $10,000 in drug proceeds, and registering the car in his own name. He asserts that the evidence produced at trial was insufficient to establish that the money was drug proceeds or that he knew the money was drug proceeds. The case is based on weak circumstantial evidence that the money in question was drug money and even weaker evidence that the defendant knew it was drug money. On the basis of the facts before us, we believe it is not possible for a rational mind to conclude with confidence, or "beyond a reasonable doubt," that Bobby McDougald violated 18 U.S.C. § 1956.
