We granted certiorari to review the judgment of the Colorado Court of Appeals in Lanari v. People, 811 P.2d 399 (Colo. App. 1989), affirming jury verdicts convicting Robert Brad Lanari, the defendant, of offenses of first degree murder,*fn1 attempted first degree murder,*fn2 and four counts of crime of violence.*fn3 When, prior to trial, the defendant sought to introduce expert psychiatric testimony to describe characteristics of the offense of heat of passion manslaughter, section 18-3-104(1)(c), 8 C.R.S. (1978 & 1985 Supp.),*fn4 and to establish that at the time the defendant participated in the events underlying his prosecution his mental state was consistent with the state of mind requisite for that offense, the prosecution filed a motion to prohibit the introduction of such testimony. The trial court granted the motion, and later denied a motion filed by the defendant to prohibit prosecutorial use for impeachment purposes of statements made by the defendant to the psychiatrist. The Court of Appeals affirmed those rulings. We affirm in part, reverse in part, and remand with directions.
