George Lamore filed this action under section 301 of the Labor Management Relations Act. It alleged that his union, Local 87, United Rubber Workers (Local 87), breached its duty of fair representation and that his employer, Inland Division of General Motors Corporation (Inland), breached its collective bargaining agreement. The district court dismissed Lamores action because he failed to file a timely grievance and failed to prove that it would have been futile to file a grievance. We affirm the dismissal of Lamores action against Inland, but remand for additional fact finding concerning Local 87s breach of its duty of fair representation.
